Evan Lohr

Evan practices in the areas of estate litigation, estate planning, probate administration, real estate and guardianship matters. Prior to forming the firm, he practiced with two other Raleigh firms. He has assisted clients with estate, trust, guardianship, and real property issues in more than fifty counties throughout North Carolina, but primarily in the central and eastern parts of the state, and is admitted to practice law in all North Carolina state courts as well as the United States District Court for the Eastern District of North Carolina.

Evan earned a bachelor’s degree in political science from the University of North Carolina at Wilmington and received his law degree from the University of Tennessee, where he served as a research assistant on the legal treatise Bogert’s Trusts and Trustees. He has also served as editor of The Administrative Lawyer, a newsletter published by the North Carolina Bar Association.

A Raleigh native, Evan has served as president of Holy Trinity Lutheran Church, among several other community activities, and has three children, Sally, Foard, and Elizabeth.

Recent Representative Experience

– Has recovered hundreds of thousands of dollars for a number of clients alleging that they were injured by the wrongdoing of a fiduciary.

– Defended a Moore County client who was sued for allegedly removing approximately $500,000 in personal property from an elderly family member’s home. After extensive litigation, the client returned less than $10,000 of property. Also, successfully argued that an attorney fee award in excess of $10,000 against client, which had been been entered while client was represented by previous counsel and held in contempt of court, not be enforced.

– Recovered a home and other property for a client after winning a directed verdict motion during a jury trial in a will caveat case in Martin County.

– Successfully represented both petitioners and respondents in contested guardianship hearings in numerous counties, including Wake, Durham, Guilford, and Wilson.

– Represented many individuals in petitioning for the partition of jointly-held real or personal property.

– Assisted hundreds of clients with probate administrations and all types of small estate administrations.

– Represented many clients in various estate proceedings before the clerk of court, including petitions for the elective share, to remove the executor of an estate, to remove a trustee, and petitions to ascertain the beneficiaries of an estate.

– Drafted hundreds of estate plans, including many for individuals and couples with multi-million dollar estates.

– Drafted many pre-marital agreements for individuals with multi-million dollar estates.

– Successfully represented individuals before the Raleigh City Council and Raleigh Planning Commission in zoning and land use matters.

– Successfully represented many landowners in eminent domain takings initiated by the North Carolina Department of Transportation and the City of Raleigh.

– Drafted many different types of contracts and have represented small businesses in a wide variety of matters, including drafting operating agreements and employment agreements.

– Have represented clients in cases involving breach of contract, fraud, negligence, and a number of other causes of action.
